Abstrakti

Case WinCapita is undoubtedly the criminal case which has drawn the most public attention in recent years. The Finnish Supreme Court gave on 27 February 2014 the advance ruling KKO 2014:7 in the criminal offence against WinCapita􀀀s main operator Hannu Kailajärvi and his female accessory.

Supreme Court considered that Kailajärvi and his accessory were guilty not only for aggravated fraud but also for money collection crime. Supreme Court’s ruling addressed various legal questions. The most significant of them was whether the principle of legality prevented the Court from convicting Kailajärvi and his female accessory for money collection crime. Ruling dealt also with other minor legal questions.

This case commentary covers case WinCapita. Emphasis is on the question concerning the significance of principle of legality. Other questions are also briefly discussed.
