Statistical analysis of the factors affecting sentencing in economic offences cases
Sentencing practices have been discussed somewhat in earlier legal studies. However, there is currently no empirical evidence with statistical certainty. In this study, we analyse sentencing in economic offence cases from 2015 to 2020 using a quantitative method. We made several significant findings in this study. The first is that the choice between conditional and unconditional imprisonment is made before the length of the imprisonment is decided. The second is that in economic offences, the sentence length is mostly based on the financial benefit obtained by the crime and the financial damage caused by it, which explains most of the sentence length. The final finding was that in economic offences, the sentence is almost always conditional if the length of the sentence is less than two years. This finding indicates that District Court practices differ from the precedents of the Supreme Court.
