Abstrakti

Expertise in lawyering – attorneys’ work in custody disputes as an example

The article examines attorneys’ conceptions of expertise required in disputes related to the children’s rights. The survey question is answered on the basis of the responses collected from attorneys (N=76). The material is analysed qualitatively by means of a theoretically guided content analysis, the reference framework of which is the expertise model created through the expertise research. According to the results of the article, an attorney is required to have varied expertise in the children’s rights matters, which can be structured according to the general concept of expertise: 1) Theoretical knowledge, such as knowledge of legislation and case law. 2) Experiential knowledge, such as work experience and personal parenting experience. 3) Self-regulatory knowledge, such as patience, determination, thoroughness and independent assessment of the matter. 4) Socio-cultural knowledge, such as listening and interaction skills and a conciliatory and friendly approach. 5) Problem-solving skills, such as the ability to promote reconciliation and propose creative solution options. 6) Social responsibility, such as promoting the best interests of the child and taking into account the perspectives of both parents. 7) Emotional dimension, such as empathy and the ability to recognise and distance yourself from the emotions of the parties.
