Lapsen oikeus perusopetukseen kotiopetuksessa perus- ja ihmisoikeusnäkökulmasta

Perusoikeus perusopetukseen turvataan lasten osalta oppivelvollisuudella, jonka voi suorittaa kouluopetuksen lisäksi kotiopetuksessa. Voimassa oleva kansallinen oikeus tunnistaa sekä huoltajan laajan päätösvallan että lapsen oikeuden opetukseen. Tässä lainopillisessa artikkelissa otetaan kanta huoltajan vapauden ja lapsen oikeuden väliseen suhteeseen tarkastelemalla, millaisia ehtoja lapsen oikeudet asettavat kotiopetuksen sääntelylle.
Lapsen perus- ja ihmisoikeus perusopetukseen asettaa valtiolle positiivisia toimintavelvoitteita oikeuden turvaamiseksi. Lapsen oikeudet asettavat tarkempia velvoitteita kotiopetuksen sääntelylle ja toteutukselle. Kuitenkin voimassa olevan sääntelyn mukaan huoltajalla on oikeus päättää lapsen kotiopetukseen siirtymisen lisäksi myös sen sisällöllisestä toteutuksesta, kun taas kunnan valvontavastuu kohdistuu vain lapsen oppivelvollisuuden edistämiseen. Käytäntö perustuu tulkintaan kotiopetuksen vapaudesta, jonka ala oppivelvollisuuden suorittamiseen tähtäävän koulutuksen osalta kyseenalaistetaan. Ihmisoikeussopimusten mukainen kotiopetus edellyttää valtion asettaman vähimmäistason mukaista opetuksen sisältöä sekä tuon opetuksen tehokasta valvontaa.
Tutkimus osoittaa, että kotiopetuksen sääntelyä ja toteutustapaa on kehitettävä. Ihmisoikeussopimusten asettamien ehtojen rajoissa lainsäätäjän on säänneltävä, miten turvataan sekä huoltajien oikeus valita lapselleen muutakin kuin julkisen vallan järjestämä koulutus että lasten yhdenvertaisuuden turvaava perus- ja ihmisoikeus perusopetukseen.
Child’s right to basic education in home education from the perspective of fundamental and human rights
The fundamental right to basic education is secured for children through compulsory education, which can be completed as homeschooling in addition to school teaching. Current national law recognises both the guardian’s extensive decision-making power and the child’s right to education. This legal article takes a stand on the relationship between the freedom of the parent and the rights of the child by examining the conditions that the rights of the child place on the regulation of homeschooling.
The child’s fundamental and human right to basic education imposes positive action obligations on the state to safeguard justice. The child’s rights impose more detailed obligations on the regulation and implementation of homeschooling. However, according to the current regulations, the guardian has the right to decide not only to transfer the child to homeschooling but also on its implementation in terms of content, while the municipality’s supervision responsibility is only focused on promoting the child’s compulsory education. The practice is based on an interpretation of the freedom of homeschooling, the scope of which is called into question with regard to education aimed at completing compulsory education. Homeschooling in accordance with the human rights conventions requires that the content of teaching complies with the minimum level set by the state and that teaching is effectively supervised.
Research shows that the regulation and implementation of homeschooling needs to be developed. Within the limits set by the human rights conventions, the legislator must regulate how to ensure both the right of guardians to choose an education for their child other than that organised by the public authorities and the fundamental and human right to basic education that ensures equality for children.
