Subjective right to day care: Social law, child law, or both?
The current government in Finland has decided to restrict families’ subjective right to day care services. If one of the parents is taking care of a child at home and receives maternity, paternity, parental or child home care allowance, or is unemployed, the other children of the family only have the right to half-day day care. The article analyses the planned restriction from the viewpoint of two particular legal disciplines, i.e., social law and child law. The authors claim that although the proposal is not entirely unproblematic, the restriction does not contradict the norms and principles of either of the two fields of law and is thus viable. It is also argued that the case in point, i.e., the restriction of the subjective right to day care, validates the status of child law as an independent legal discipline.
