Abstrakti

For analysis: the Hohfeldian framework in the era of fundamental rights

The article addresses the theoretical framework created by Wesley Newcomb Hohfeld. The aims of the article are twofold. Firstly, recent scholarship pertaining to the framework is presented and analysed. It is argued that the Hohfeldian theory is helpful in understanding, for instance, whether mutually conflicting duties can exist and whether one can have the ”right to do wrong”. Secondly, the article aims to show how Hohfeld is still relevant despite the rise of fundamental rights jurisprudence: The theory complements other methodological approaches, such as the doctrinal and the law-and-economics approaches.
