Abstrakti

Regulatory burden and the protection of the environment

Cutting unnecessary regulatory burden on businesses has been a key policy objective throughout Europe and the OECD countries for many years. Meanwhile, the research has focused on how to conceptualise, assess and decrease regulatory burden. However, the sources and mechanisms behind unnecessary regulatory burden have drawn less academic attention. The aim of the authors is to analyse the sources of burden in environmental regulation, sometimes identified as one of the most burdensome fields of regulation for businesses. The analysis points out that while there are some common structures behind regulatory burden, identification of the exact source of burden requires expertise on the particular area of regulation and its implementation practices. Besides, sometimes measures intended to cut regulatory burden end up increasing it instead. Thus, the role of implementation, as noted in discussions on regulatory burden, is particularly important as regards environmental regulation. Finally, undertakings may ready to accept unnecessary regulatory burden if it creates conditions for placing their products on the European market.
