New Nordic sexual offences law: On the applicability of Swedish legislative solutions in Finland
In this article, the new Swedish legislation on sexual offences is analysed from the Finnish perspective. In Sweden, the new legislation entered into force on 1 July 2018; it is based on the lack of voluntary participation on the side of the victim. In Finland, the present government has stated as its goal that also Finland will amend its sexual offences law so that the definition of rape would cover all situations in which the victim has not given consent to sexual intercourse. Also in academic discourse, the voices in favour of consent-based legislation are getting louder. Traditionally, Finland has been following the Swedish example closely; also this article serves the purpose of critical discussion on the pros and cons of the solutions chosen in Sweden and the transferability of those legislative choices to Finnish law.
