Responsibility for public service arrangement and quality control – with a focus on housing services
This legal dogmatic study focuses on a public administrative organisation’s responsibility for service arrangement, especially as regards administrative decisions, service procurement contracts, and the supervision arrangements when private service providers produce enhanced housing services. In this respect, enhanced housing services are defined as housing services under section 21(3) and (4) the Social Welfare Act, that is, public social housing services for persons who need to be cared for and maintained 24 hours a day. According to the social welfare and health care legislation, municipalities (local authorities) are responsible for arranging these services as needed, e.g. by procuring them from the private sector. The study examines the stages of the outsourcing process regarding quality and its control. The question is of a more precise understanding of the concept of an organisation’s responsibility for public service arrangement and clearer systematisation of the organiser's responsibilities.
