Abstrakti

New sources for researching EU law

The article highlights new avenues and sources of information for conducting research on the Court of Justice of the European Union and its case-law. It evaluates possible new research questions that the new material provides. The author studies the transparency rules and practices of the Court, as well as the case-law that has recently changed these practices. The case-law makes it clear that it is possible, through access to documents requests, to gain access to documents submitted by parties and interveners in a particular case. The author examines the importance of this new material for researching the Court of Justice and the meaning of this new research material in the light of the methodological premises of EU law. The author argues that this research material is relevant for legal scholars especially when conducting empirical research, but it can also enrich the dogmatic research of EU law.
