The legal framework of the law drafting process

In the article, we discuss, from a legal perspective, the regulation of the law drafting as a part of the Finnish legislative process. Our perspective differs from the traditional way to approach the guidance of law drafting solely as regulatory
policy. As we explain in the article, good law drafting is linked to constitutional law, ensuring the principles of the rule of law and democratic decision-making. To enact new legislation is a duty of Parliament. In practice, the central content of laws is frequently already determined in the drafting phase. Thus, as the Government’s proposal and its drafting are highly important for the subsequent parliamentary procedure, it is significant to be familiar with the legal requirements set for them. We begin the article by analysing the legislation that sets demands for legislative drafting. We then briefly discuss the regulatory guidelines and recommendations provided by numerous national and international actors such as the OECD and the European Commission. As a final part of our analysis of the legal framework, we discuss the opinions of the Constitutional Law Committee and the Highest Legal Overseers (Parliamentary Ombudsman and Chancellor of Justice) on the law drafting that reflect the qualities of good legislative practices and clarify the content of the legislative framework. In conclusion, we argue that our article indicates the existence of the legally binding procedural framework of the law drafting process that should be taken into account in the drafting. The article also enhances understanding of the significance of legal regulation in the context of the quality of the legislative drafting process.

Teaching assistant as a co-teacher – students’ experiences of the effect of a teaching assistant on the learning atmosphere and the quality of instruction

In Finnish law faculties, it is fairly common to have students working as teaching assistants in different roles and tasks. Their role as co-teachers and the effect this might have on different aspects of the learning environments and processes has not been studied before. Previous studies have identified several areas in need of development in Finnish legal education such as instruction and feedback for students, learning environments, interaction between the teacher and the students, as well as the approachability of teachers.
The article focuses on two questions: 1) How do law students experience the effect of the teaching assistant as a co-teacher on the learning atmosphere? 2) How do law students experience the effect of the teaching assistant as a co-teacher on the quality of instruction? The analysis is based on a survey, collected from 63 first-year law students who participated in an obligatory course on legal decision-making.
The article’s main conclusion is that the students’ views on the teaching assistant’s effect on learning atmosphere and quality of instruction were very positive. According to the students, the teaching assistant improved the mood of the course, made it easier for the students to ask questions and request advice, and provided extra content and guidance, making the materials and instructions at the same time more understandable and useful. The students also considered the teaching assistant as encouraging and identifiable. All in all, giving law students a role as co-teachers seems to be a promising way to tackle many development needs in Finnish legal education.

Shareholders’ nomination board

The shareholders’ nomination board is a typical way to prepare shareholder proposals regarding the board for the general meeting. It is not a recognised body under the Companies Act but rather a local Nordic governance arrangement described in self-regulation and established by the decision of the general meeting. The nomination board organises the largest shareholders of the company and unites their decision-making under a unified and coordinated operation, thereby institutionalising the exercise of control by the controlling shareholders. The nomination board can be considered an agent for other shareholders. In self-regulation, specifics are left to be determined in company-specific terms, within the limits set by company law. The formulation of recommendations has led to varying practices in companies. The position and role of the nomination board are influenced by company-specific regulations and ownership structures.

Responsibility for the oversight of health and medical care within public health care and the position of the physician-in-charge

Section 57 of the Finnish Health Care Act stipulates that there must be a physician-in-charge in every public health care unit. The duty of the physician-in-charge is to lead and supervise the health and medical care in the health care unit, i.e. the content of health care services. The physician-in-charge works alongside the organisation’s official bodies and public officials, and the management structure of public healthcare thus forms a matrix based on law. The management tasks of the health care organisation must be arranged in such a way that they do not obstruct the physician-in-charge in performing their statutory duties. The responsible physician’s official authority must be understood as a directive power existing alongside the organisation’s administrative management system. In practice, the physician-in-charge does not manage individual health care professionals but gives binding directives to all professionals regarding treatment methods and processes.
In addition to the authority based on the Health Care Act, the physician-in-charge may have delegated authority based on the Wellbeing Services County Act. The basis of jurisdiction affects the appealability of the decisions made by the physician-in-charge and should be considered in the appeal instructions related to the decisions. As a rule, decisions based on the Health Care Act are not subject to appeal, but decisions based on the Wellbeing Services County Act can be appealed.
The position of the physician-in-charge forms one element in the legislation securing adequate health services, based on Constitution Act § 19.3. Since the provision of health services is ultimately based on the treatment decisions made by physicians and the physician’s autonomy, the organisation of health services cannot be left solely to the decision-making of elected officials. Ensuring the equality of treatment also requires the management and supervision of physicians’ decision-making.
