The influence of politics on constitutional interpretation – Ex ante
constitutional review by the Constitutional Law Committee as an example

In this article, I analyse the interplay between law and politics in ex ante constitutional review in Finland. I use the Finnish ex ante non-judicial constitutional review as an example of a process in which the influence of politics on constitutional interpretations is an integral element. In this case, the body responsible for the constitutional review of forthcoming legislation is a parliamentary committee – the Constitutional Law Committee (CLC) – which consists of Members of Parliament. Interestingly, however, Finnish constitutional custom requires CLC members to base their interpretations on legal argumentation and set aside their political interests. In this article, I study empirically how law and politics interact in constitutional interpretations through a qualitative case study incorporating 49 semi-structured interviews with key actors involved in the work of the CLC. More precisely, I analyse how the distinction between law and politics is understood in constitutional interpretation by the key actors themselves, and whether constitutional interpretation entails features of both political and legal decision-making. In order to do so, I draw on interviews with (a) MPs who have worked in the CLC, (b) secretaries of the CLC, and (c) legal experts who have acted as external advisors to the CLC.

Selecting the type of imprisonment for first-time offenders

The Criminal Code’s system of sanctions is based on an idea of a gradual increase in severity. In offences for which the only punishment is imprisonment, this idea is realised through legislation by conditional imprisonment being the primary sanction in cases where the length of the sentence is no more than two years and where the severity of the offence, the guilt of the perpetrator or their earlier offences do not require unconditional imprisonment.

The grounds for selecting the type of imprisonment have to do partly with assessing the offence at hand and partly with the earlier offences committed by the defendant. The article examines the decisions to be made for the imprisonment of first-time offenders and especially the question of at what point the severity of the offence and the guilt of the perpetrator weigh more on the scale than the status as a first-timer, and thus require unconditional imprisonment. The focus is therefore on cases where the length of the sentence approaches two years.

At the centre of the study is a systematic reading of the case law of the Supreme Court and a critical examination of interpretative choices made therein. In addition, the study is based on the analysis of hundreds of district court judgments, collected for this very purpose.

The results of the study show that the practice of selecting the type of imprisonment in lower courts is substantially more lenient than the practice of the Supreme Court. In the lower courts, the presumption favoring conditional imprisonment does not usually appear to turn toward unconditional imprisonment even when the length of the sentence reaches two years. This differs from the stand taken in Supreme Court case law, legislative history and legal literature.

Exploitation of employees through severe underpayment – which criminal offence is it?

The article examines criminal law issues related to exploitation of employees through severe underpayment. In particular, the article examines how severe underpayment can be addressed under the current provisions of the Finnish Criminal Code and whether the Criminal Code should be developed to enable a more effective intervention in underpayment. Of special interest are the new offences that have been proposed in Prime Minister Petteri Orpo’s Government Programme. The article concludes that no new provisions are needed to combat
the exploitation of employees through severe underpayment, but advocates adopting a new point of view towards the phenomenon in criminal law.

Children’s experiences of violence in sports activities

Every child has the right to participate in sports in a healthy and safe environment, as articulated in Article 19 of the Convention on the Rights of the Child (CRC). Nevertheless, research suggests that minor athletes (under 18 years of age) encounter various forms of violence within sports activities. Such violence can be particularly detrimental to children with effects that may be significant and enduring. Additionally, children may struggle to recognise and respond to violent behaviour. Our study aimed to examine the prevalence, types and perpetrators of violence among minor athletes in Finnish sports, alongside examining
the role of sports regulations and legal remedies in safeguarding child athletes.

To address these objectives, we conducted an online survey involving child athletes (N=3,030). Statistical analysis of the survey data was performed using the SPSS program, employing techniques of frequency distributions, cross-tabulation and the Chi-square test. Furthermore, Finnish sports law and regulation was subjected to legal dogmatic analysis.

The findings revealed that: a) various forms of violence are present in Finnish sports, with emotional violence being the most prevalent; b) children can be both victims and perpetrators of violence in sports; and c) many children choose not to speak about violence and, even when they do, the matter may not be adequately addressed, leading to continued violence. These findings underscore the importance of initiatives aimed at fostering openness, equality, ethics and safety within sports environments.
