Abstract

This essay seeks to discuss, in light of the Hong Kong constitutional and legislative framework, whether it would be legally valid to mpose a cap on the number of breeding dogs a commercial breeder is licensed to keep. Though framed apparently as a narrow question, the topic highlighted the tension between animal welfare and constitutional rights, touched on the property status of animals, and enabled a discussion on better drafting of animal welfare legislations.
