Abstract

In recent years, climate change and children’s rights have been hot topics in the field of international law. Paris Agreement set a goal for climate mitigation actions: to keep the global temperature well below 2 °C. However, developed countries are far behind that target. Thus, many children have taken action and initiated legal proceedings in the international legal
bodies.

This article aims to enlighten the reader on the positive obligations of the European Convention on Human Rights towards children on climate change in the light of article 8. Moreover, the article delves into the position of children in our society and their vulnerability. The article also explores the challenges children face in asserting their rights. It divides
positive obligations into three categories: the authorities’ obligations, the obligations of the legislator, and the obligations of the courts. In conclusion, the author brings up the obstacles in the way of the full enjoyment of environmental rights in the human rights system.
