Abstrakti

Access to CCTV footage: An empirical study of national and EU law

The authors look into the status of recorded CCTV footage in both European Union and Finnish national public organisations both as personal data and as public documents. They outline the legal framework for the confidentiality of and access to such footage. They then dive deeper by empirically examining the application practices of the authorities, so as to systematise the legal status of the footage and the margin of discretion of the authorities.

In assessing whether to grant access to CCTV footage, an authority should balance the interests in favour of granting access and the potential risk of undermining security arrangements. An authority has discretion to decide where, when and in what form the footage is released or access granted to it. Compared to public release, granting access by way of showing the footage at the premises of the authority may cause less disadvantage. This would achieve the best balance between competing interests.
