Securing the rights of future generations in Finnish constitutional law
The article analyses the significance of future generations and the realisation of their rights in Finnish constitutional law. The research question posed asks how the rights of future generations are protected in the Constitution, its preparatory works and the relevant general doctrines of constitutional law. The article forms an in-depth constitutional doctrinal overview of the constitutional legal situation in Finland for future generations and highlights its possible directions and needs for change. The conclusions emphasise the silence of our constitution regarding the rights of future generations and the fact that we do not have a clear understanding of the meaning of future generations and their rights in terms of the constitution. Most clearly, future generations enjoy fundamental rights protection within the framework of environmental rights. In addition to this, future generations and their rights could also gain constitutional significance in many economic and social-cultural contexts. Greater protection of the rights of future generations should already be the result of taking human rights and EU obligations seriously. The author concludes that it is not necessary to legislate on the rights of future generations at the level of the Constitution, nor is it necessary to abandon the starting points included in the general doctrines of constitutional law in defining the scope of fundamental rights protection.
